Fort William Historical Park (FWHP) Vendor
Vendors accepted to operate at FWHP festivals will be required to:
- Pay a vendor fee of $ XXX, at the time of their application, payable to XXX, to help offset festival costs;
- Comply with all provisions of law, including, without limitation, all federal and provincial legislative enactments, municipal by-laws and any other governmental by-laws and regulations and orders;
- Have, on hand at their concession booth at all times:
- proof of motor vehicle liability insurance for both owned and non owned licensed vehicles having limits of not less than $2,000,000.00 inclusive per occurrence for bodily injury, death, and damage to property;
- proof of general liability insurance having limits of not less than $2,000,000.00 inclusive per occurrence for bodily injury, death, and damage to property;
- proof of Workplace Safety (WSIB) or other accident insurance for its workers. The vendor is responsible for all costs associated with workplace accidents and all premiums or assessments owing to the Workplace Safety and Insurance Board (WSIB), or insurance company.
- proof of their most recent Health Inspection reports;
- Comply with the Occupational Health and Safety Act, 1990 and Regulations, and will be responsible for the compliance therewith of any drivers or employees;
- Accept any vending location supplied by FWHP without dispute. FWHP will make every reasonable attempt to place you in the best location for the ultimate success of the festival;
- Set up, stock up and tear down your vending site only when permitted by FWHP;
- Operate at all times while the festival or event is open to the public. Late openings and early closings will not be allowed;
- Operate without any guarantee of business volume and in all types of weather;
- Cease operations when requested to do so by FWHP without hesitation or dispute;
- Operate without excessive noise and without public broadcast systems, radios, DVD, MP3 or other disruptive noises;
- Obtain all electrical and gas permits in advance of operating, if applicable; service;
- Provide a menu or product list with prices. FWHP may request prices be changed to provide consistent pricing across all vendors;
- Only use your vending location to sell approved menu items;
- Bring enough small bills and coins to operate without disrupting other vendors for change;
- Dispense beverages in original plastic bottles, if applicable;
- Sell exclusive brands of food or beverages, if applicable, as requested by FWHP;
- Set up your vending booth within the allowable space. The minimum vending space is 17 ft. 9 inches wide by 40 ft. deep (the average is 19 ft. wide by 48 ft. deep and some exceed 50ft. in width and depth). This space includes all allowable space for your customer service counter, your preparation area, your storage trailers or trucks, tent ropes, exterior equipment, signs and employee vehicles. This space does not include a planned unobstructed service lane for fire, police or other uses, of 10ft. between vendors;
- Utilize existing ESA approved pedestals for electrical power. You will have a power hook-up choice of 1 - 30A, 125V rated receptacle NEMA designation TT-30R, OR, 1 - 50A, 125/250V rated receptacle NEMA designation 14-50R, OR, 2 - 20A, 125V rated duplex GFCI receptacles. Vendors must bring all of their own plugs/adapters/panel connections, at their own cost. These connections must be made to the pedestals and meet ESA approval or the pedestal service will be turned off;
- Utilize potable water provided at the pedestal, if applicable;
- Remove all vending waste, recycling and grey water to FWHP provided sites;
- Obtain professional locate services for tent stakes in excess of 24 inches at your own expense;
- Attend festival or event organization meetings;
- Not sell alcoholic beverages including any product commonly known as near beer;
- Provide presentable vending tents or portable buildings;
- Provide clear professionally prepared signage and menus;
- Provide excellent customer service including personal hygiene, uniforms and other professionalism;
- Provide a list of staff names that will be providing service on the site during the festival. This list will support vendor admission requirements for the festival;
- Provide a list of staff vehicles that will be providing transportation service to the site during the festival. This list will support vendor parking requirements for the festival;
- Not permit any act by your employees that mars or defaces the premises in any manner;
- Provide a written statement of gross sales and total wages paid, during the festival for the purpose of estimating the festival's economic impact;
- Collect and remit applicable sales taxes;
- If accepted, enter into a formal agreement with FWHP;
- Surrender the space occupied by them in the same condition as it was at the commencement of occupation. Any damage done to the premises by the vendor shall be made good to FWHP as their interest may appear.
